Excessive Fees: Investments Performance
Complaint alleges the plan sponsor allowed did not prudently select or monitor investments thereby causing
participants to pay excessive fees when lower-cost and/or better performing alternatives were available.
Examples
• Peterson v. Insurance Services Office: Claimed imprudent selection and retention of investment options
despite availability of lower cost share classes and/or comparable investments.
• Proposed settlement of $4 million.
